01. Tell Me About Your Project

Start by filling out the project enquiry form with as much information as you have available.You do not need to have every detail figured out before getting in touch. A rough idea of what you need, what the project is for, your preferred timeframe and approximate budget is enough to get the conversation started.

02. Scope & Quote

I'll review your enquiry and discuss any details needed to establish the project scope.You'll then receive a written quotation covering the agreed:Deliverables

Price
Usage or ownership rights
Revision arrangements
Any relevant third-party costsThere is no obligation to proceed simply because you have requested a quote.

03. Booking & Deposit

Once the quote and scope have been agreed, a deposit may be required before work begins.Your project is considered booked once any required deposit has been received and the project has been confirmed.

04. Design & Feedback

I'll develop the work according to the agreed brief and share appropriate concepts, drafts or progress for review.Feedback should ideally be consolidated into a single response where more than one person is reviewing the work.Reasonable revisions within the agreed brief are included as described in your quote.Major changes of direction, additional deliverables or work outside the agreed scope may require an updated quote.

05. Approval & Final Delivery

Once everything has been approved and the final balance has been paid, your agreed final files or website will be prepared for handover.The formats and rights included will be confirmed as part of your project quote.

Revisions

Revisions are intended to refine the agreed creative direction rather than restart the project from scratch.For logo and identity projects, reasonable refinement that remains consistent with the original approved brief is generally included rather than being restricted to an arbitrary number of tiny changes.Other projects may include a specified number of revision rounds.A significant change to the agreed brief, creative direction, functionality or project scope may be treated as additional work.Your quotation will explain the revision arrangements for your project.

Turnaround

Project schedules vary depending on scope, current availability and how quickly feedback and materials are provided.You'll receive an estimated schedule before committing to the project.If you have a particular deadline, please include it in your enquiry.Rush work may not always be available and may require an additional fee where it significantly changes the planned schedule.

Who am I?

Hey, I'm Charlie!

A Scottish graphic and web designer working as Wilkistration on a freelance basis. Creating thoughtful, characterful design for creatives, indie developers and small businesses.My background spans Computer Arts, Game UI Design and Software Development, which means I tend to approach design from both a visual and practical perspective. I enjoy making things that look distinctive, but also thinking about how they work, how people interact with them, and how they can be made more accessible and enjoyable to use.My work covers everything from logos, branding and promotional graphics to web design and game UI, with a particular fondness for colourful, playful design that still feels polished and purposeful.I graduated from Abertay University with a BA (Hons) in Computer Arts, and alongside freelance design I've continued developing my skills across UI, accessibility, web development and interactive media.When I'm not working on client projects, I'm usually making games, designing interfaces, building small creative tools, or finding another fun wee project to dig my teeth into!

Terms of Service

These Terms of Service apply to services provided by Charlotte Wilkinson trading as Wilkistration ("Wilkistration", "we", "us") to the individual, business or organisation commissioning the work ("the Client", "you").Please read these Terms before commissioning any work.By approving a quotation, paying a deposit, instructing Wilkistration to begin work, or otherwise entering into an agreement for Wilkistration's services, the Client agrees to these Terms.Any quotation, project brief, proposal, Data Processing Addendum or other written project agreement forms part of the agreement between Wilkistration and the Client. Where a project-specific written agreement expressly differs from these Terms, the project-specific agreement will take priority for that project.

Core Terms
_{1. Services}
Wilkistration provides graphic design, branding, illustration, website design and related creative services.The specific scope, Deliverables, fees and estimated schedule for a project will be set out in the applicable quotation, brief or project agreement.For the purposes of these Terms, "Deliverables" means the final work specifically agreed to be supplied to the Client.Anything not expressly included within the agreed scope may be treated as additional work and charged separately._{2. Quotations}Quotations are prepared using the information and requirements available at the time they are issued.A quotation may be revised where:• the Client changes the agreed brief or scope;
• additional Deliverables or functionality are requested;
• information supplied by the Client proves incomplete or inaccurate;
• previously approved work must be substantially revised; or
• circumstances outside Wilkistration's reasonable control materially affect the work required.Unless expressly stated otherwise, quotations and project timescales are estimates.All fees are quoted and payable in Pounds Sterling (GBP).Any taxes or other charges legally required to be applied will be identified separately where applicable._{3. Deposits and Payment}Wilkistration may require a deposit before beginning a project.Where a deposit is required, work will not normally begin until payment has been received.The remaining project balance will be invoiced according to the payment schedule stated in the quotation or project agreement.Unless otherwise agreed in writing, invoices are payable within 30 days of issue.Wilkistration may pause work, withhold final files, withhold website handover or decline to undertake additional work while an invoice remains overdue.Rights in final Deliverables do not transfer to the Client until the relevant project has been paid for in full.Commercial ClientsWhere the Client is acting in the course of business and applicable legislation allows it, Wilkistration reserves the right to charge statutory interest and claim applicable recovery costs in respect of overdue commercial invoices.This provision does not apply to consumer Clients where the relevant commercial late-payment legislation does not apply._{4. Client Responsibilities}The Client is responsible for providing all information, materials, access, feedback and approvals reasonably required to complete the project.The Client must ensure that information supplied to Wilkistration is accurate.Where the Client supplies text, images, photography, illustrations, logos, fonts, software, code, trademarks or other material, the Client confirms that they own that material or have all necessary rights and permissions to use it for the project.Wilkistration is entitled to rely on the Client's confirmation of those rights and is not required to independently investigate ownership or licensing.The Client remains responsible for obtaining any legal, regulatory, copyright, trademark, tax or other specialist advice required for their business or project._{5. Authorised Client Contact and Approvals}The Client should nominate one primary contact who is authorised to provide instructions, feedback and approvals on the Client's behalf.Wilkistration is entitled to rely on instructions and approvals received from that person unless notified otherwise in writing.Where several people are involved in reviewing a project, the Client is responsible for consolidating feedback into a clear and reasonably consistent response.Conflicting instructions from multiple Client representatives may delay the project and additional work required to reconcile or revisit previously approved decisions may be chargeable.Communication and TimescalesThe Client agrees to provide feedback and project materials within a reasonable timeframe.Delivery dates may be affected by:• delayed Client feedback or approval;
• missing materials;
• changes to the brief;
• third-party delays;
• illness, emergencies or other circumstances outside Wilkistration's reasonable control; or
• additional work requested by the Client.Unless Wilkistration expressly guarantees a date in writing, project completion dates are estimates only._{6. Inactive Projects}If the Client fails to respond or provide required materials for 30 days, Wilkistration may consider the project inactive.At that point, Wilkistration may invoice for work completed to date.Wilkistration may also invoice for work completed where a project remains open for more than 60 days, including where completion has been delayed by the Client.Resuming an inactive project will depend on Wilkistration's availability and may require a revised schedule or quotation._{7. Changes and Additional Work}Work falling outside the agreed brief or scope will be treated as additional work.This includes, where applicable:• new concepts or directions after a direction has been approved;
• additional Deliverables;
• significant changes to previously approved work;
• substantial changes to project requirements;
• additional pages or website functionality;
• additional file formats not included in the original agreement; and
• work required because of incorrect or incomplete Client-supplied material.Additional work will be charged at the rate specified in the quotation or otherwise agreed with the Client.Where reasonably practicable, Wilkistration will notify the Client before undertaking substantial chargeable work outside the original scope._{8. Cancellation}Either party may cancel a project by providing written notice.If the Client cancels after work has begun, the Client must pay for work completed up to the date of cancellation together with any non-refundable expenses or third-party costs reasonably incurred for the project.Any deposit already paid will be credited against the amount owed.Where the amount properly payable is less than the deposit received, any refundable balance will be returned to the Client.Wilkistration may terminate a project where the Client:• materially breaches these Terms;
• repeatedly fails to make required payments;
• requests unlawful work or use of the Deliverables;
• engages in abusive, threatening or discriminatory behaviour; or
• otherwise makes continued performance of the project unreasonable.Nothing in this section overrides standard statutory cancellation or refund rights available to a consumer._{9. Intellectual Property}Unless otherwise agreed in writing, Wilkistration remains the owner of all intellectual property created during development of a project until payment has been received in full.This includes:• concepts;
• drafts;
• rejected designs;
• sketches;
• working files;
• development materials; and
• preliminary Artwork.Payment for a project does not automatically grant the Client ownership of unused or rejected concepts.Final DeliverablesThe intellectual-property rights granted in the final Deliverables will be those stated in the quotation or project agreement.Depending on the project, this may take the form of:• an agreed licence to use the final Deliverables; or
• an assignment of Wilkistration's copyright in specifically identified final Deliverables.Where a copyright assignment is agreed, it will apply only to the final Deliverables expressly identified as being assigned and will take effect once the agreed fees have been paid in full and any legally required written assignment has been completed.Unless expressly agreed otherwise, the transfer or licence does not include:• unused concepts;
• rejected designs;
• working documents;
• source or editable files;
• development utilities;
• reusable code;
• templates;
• reusable design systems;
• production techniques;
• fonts;
• stock material;
• third-party software; or
• other third-party intellectual property.Third-party materials remain subject to their respective licence terms.Moral Rights and AttributionWilkistration retains and, where applicable, asserts applicable moral rights in work created for the Client, except to the extent expressly waived in writing.This includes applicable rights relating to identification as the creator, false attribution and derogatory treatment of the work.Unless expressly required by a project agreement, this section does not require the Client to place a visible Wilkistration credit on every use of the Deliverables.Any separate website credit requirements are set out in the Website Design Terms below._{10. Prohibited Uses: Generative AI, Blockchain and NFTs}The permissions, licences and intellectual-property rights granted to the Client expressly exclude use in connection with generative artificial intelligence, NFTs, cryptocurrency assets, blockchain-based tokenisation and comparable technologies.These restrictions apply to final Deliverables, concepts, drafts, working files and any other work produced by Wilkistration.They continue to apply as contractual obligations even where copyright in specifically identified final Deliverables has subsequently been assigned to the Client.Generative Artificial IntelligenceThe Client must not use, upload, submit, license, distribute or otherwise make Wilkistration's work available:• as training data for a generative AI or machine-learning model;
• for the fine-tuning, retraining or development of a generative AI model;
• as part of a generative-AI dataset;
• as an image, design, text, code, style or other reference for generating new material;
• as an input to image-to-image, style-transfer, generative-fill or comparable generative systems;
• for the creation of AI-generated derivatives, variations or imitations;
• for automated extraction or imitation of Wilkistration's artistic or design style; or
• for any other generative-AI purpose.The Client must not authorise or knowingly permit a third party to carry out such use on their behalf.Ordinary non-generative automated processes, including file compression, conventional image processing, search indexing, accessibility testing and code optimisation, are not prohibited solely because automation or machine learning is involved.Blockchain, Cryptocurrency and NFTsWilkistration's work must not be:• minted as an NFT;
• tokenised as a blockchain asset;
• sold or distributed as a digital collectible;
• associated with an NFT for sale, licensing or ownership purposes;
• uploaded to an NFT marketplace;
• fractionalised through a blockchain-based ownership system;
• incorporated into a cryptocurrency token or blockchain asset;
• used to advertise, promote or provide visual identity for an NFT or cryptocurrency project; or
• otherwise commercially exploited through blockchain-based ownership or tokenisation.The Client may not grant a third party rights that would permit any use prohibited by this section.Any exception would require a separate express written agreement signed by Wilkistration.Use of AIWilkistration's standard practice is not to use generative artificial intelligence, in any capacity.Wilkistration will not:
• upload Client confidential information to a generative-AI service;
• upload Client-owned Artwork or other supplied creative assets for generative purposes;
• use Client materials to train or fine-tune a generative model;
• use commissioned Deliverables as generative-AI training data; or
• use generative AI to create, imitate or substantially modify commissioned creative Deliverables.Wilkistration will not knowingly sell or contribute Client materials or commissioned Deliverables to generative-AI training datasets.Conventional software features that do not generate creative material, such as automated file processing, spellchecking, accessibility analysis, compression, code linting or conventional search functions, are not considered generative-AI use for the purposes of this section._{11. Portfolio and Self-Promotion}Unless otherwise agreed in writing, Wilkistration retains the right to display completed work for self-promotional purposes.This may include:• Wilkistration's website and portfolio;
• social media;
• case studies or blog entries;
• presentations;
• professional networking;
• award submissions; and
• other reasonable promotional use.Where a project is confidential, subject to an embargo or has an agreed launch date, Wilkistration will observe any publication restriction agreed in writing._{12. Confidential Information}Both parties agree to take reasonable care of confidential information supplied specifically for the project and not to disclose it unnecessarily to third parties.Information will not be considered confidential where it:• is already publicly available;
• becomes public through no breach of these Terms;
• was already lawfully known to the receiving party; or
• must be disclosed by law.Wilkistration may disclose information to a subcontractor where reasonably necessary to provide the services, provided appropriate confidentiality obligations apply.Where more extensive confidentiality obligations are required, the parties may enter into a separate non-disclosure agreement.Data ProtectionEach party is responsible for complying with applicable data-protection law in relation to personal data for which it determines the purposes and means of processing.Wilkistration may process Client contact, billing and project-administration information for the purpose of:• managing enquiries;
• providing services;
• communicating with the Client;
• issuing invoices;
• maintaining appropriate business records; and
• complying with legal obligations.Where Wilkistration processes personal data on behalf of the Client as part of website development or another service, Wilkistration will act only in accordance with the Client's documented instructions and the Data Processing Addendum at Appendix B will apply.Examples may include temporary access to:• customer databases;
• website form submissions;
• mailing lists;
• account information;
• user records; or
• other personal information • controlled by the Client.The Client remains responsible for determining the lawful basis, purpose and content of its own processing activities._{13. Third-Party Materials and Services}Projects may require third-party materials or services including:
• stock imagery;
• fonts;
• plugins;
• themes;
• printing;
• website subscriptions;
• software;
• hosting;
• domain names; or
• other licensed assets or services.Where a material third-party expense is not already included in the quotation, Wilkistration will seek Client approval before purchasing it on the Client's behalf.Wilkistration may require payment of third-party costs in advance.Third-party materials remain subject to their own licence terms.A licence obtained by Wilkistration is not automatically transferable to the Client. Where necessary, the Client may be required to purchase their own licence directly from the provider.The Client is responsible for ongoing subscription, renewal and licensing costs transferred to them after project completion.Wilkistration is not responsible for future changes made by third-party providers to:• pricing;
• licensing;
• availability;
• functionality;
• technical requirements; or
• terms of service.

_{14. Liability}Wilkistration will provide its services with reasonable care and skill.The Client is responsible for determining whether the final Deliverables meet their particular legal, regulatory, commercial or technical requirements.To the fullest extent permitted by law, Wilkistration will not be liable for indirect or consequential loss arising from the services or Deliverables, including loss of:• profit;
• revenue;
• anticipated savings;
• business opportunities;
• goodwill; or
• data.Where liability can legally be limited, Wilkistration's total liability arising from a project will not exceed the amount paid by the Client to Wilkistration for the services directly giving rise to the claim.Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.Client-Supplied Material and Third-Party ClaimsThe Client must not knowingly provide Wilkistration with material that:• infringes copyright, trademark or other intellectual-property rights;
• breaches confidentiality;
• violates privacy or data-protection law;
• is defamatory;
• is unlawful; or
• cannot legally be used for the intended project.If a third party alleges that Client-supplied material infringes their rights, Wilkistration may remove or cease using that material while the issue is investigated.Business ClientsWhere the Client is acting in the course of business, the Client will be responsible for reasonable losses, liabilities and costs arising directly from a third-party claim caused by Client-supplied materials or Client instructions that infringe another person's rights or are unlawful.This does not apply to the extent that the claim resulted from Wilkistration's own breach of contract, negligence or unauthorised alteration or use of those materials.This provision does not reduce any statutory rights available to a consumer Client._{15. Project Files and Retention}The Client is responsible for safely storing all final Deliverables supplied at completion.Wilkistration is not a permanent archival or backup service.Wilkistration may retain completed project files and working materials following completion for administrative, portfolio, backup or future-service purposes.Retention of project files is not guaranteed beyond six months from the date the project is completed or terminated.After that period, any or all project files may be permanently deleted without notice.Wilkistration cannot guarantee that editable, source or working files will remain available for future amendments.Where a Client requires long-term archival storage, this must be arranged independently._{16. Events Outside Reasonable Control}Neither party will be responsible for delay or failure to perform an obligation where performance is prevented by circumstances outside that party's reasonable control.Such circumstances may include:serious illness or incapacity;
fire or flood;
natural disasters;
widespread internet or infrastructure failure;
failure of essential third-party platforms;
industrial action;
government restrictions;
civil emergency; or
comparable events that could not reasonably have been prevented.The affected party should notify the other as soon as reasonably practicable.Affected deadlines may be extended for a reasonable period while the circumstances continue.If such circumstances make completion impracticable for an extended period, either party may terminate the affected project. The Client will remain responsible for work properly completed and authorised costs incurred before termination.

Graphic Design TermsThese terms apply in addition to the Core Terms where Wilkistration provides graphic design, branding, illustration or related visual-design services._{17. Creative Brief}The project brief establishes the agreed objectives, requirements and creative direction.The brief may be established using:• written Client requirements;
• reference imagery;
• moodboards;
• existing brand material;
• discussions or consultations; and
• other visual or written references.The Client is responsible for identifying mandatory requirements before design work begins.Significant changes to the brief after work has begun may be treated as additional work._{18. Concepts and Revisions}For logo and identity work, Wilkistration does not apply a fixed number of revisions unless a revision limit is stated in the quotation.Revisions reasonably consistent with the original agreed brief and submitted within the agreed project timeframe are included unless otherwise specified.This does not constitute unlimited redesign.Additional charges may apply where revision requests:• depart from the original brief;
• introduce a substantially different creative direction;
• revisit previously rejected or approved directions;
• require additional Deliverables; or
• are made after the agreed review period.Other graphic-design projects may include a specified number of revision rounds as detailed in the quotation._{19. Client-Supplied Artwork and Content}The Client is responsible for the quality and suitability of files they supply.Wilkistration is not responsible for quality issues caused by Client-supplied material including:• insufficient image resolution;
• incorrect colour profiles;
• missing fonts;
• corrupted files;
• unsuitable file formats;
• incorrect dimensions; or
• material supplied without appropriate usage rights.Where correcting supplied material requires additional work, that work may be chargeable._{20. Proofing and Approval}The Client is responsible for carefully reviewing final proofs before approval.This includes checking:• spelling;
• grammar;
• names;
• contact information;
• dates;
• dimensions;
• quantities;
• imagery;
• layout;
• links or QR codes where applicable; and
• any other factual information.Once final approval is given, the approved version will be treated as the Client-approved version.Changes requested after final approval may incur additional fees.Wilkistration is not responsible for errors originating in Client-supplied material or errors clearly visible in a proof subsequently approved by the Client, except where liability cannot lawfully be excluded._{21. Final and Editable Files}Final files will be supplied in the formats identified in the quotation or project agreement.Editable, layered, working or source files are not automatically included.Where editable files are required, they must be expressly included within the scope or agreed separately.Provision of an editable file does not transfer ownership of third-party assets, reusable templates, production systems or other excluded intellectual property contained within it._{22. Colour and Reproduction}Colours may vary between:• displays;
• printers;
• paper stocks;
• production methods;
• colour profiles; and
• different manufacturing batches.A digital screen preview cannot guarantee exact colour reproduction in print.Where the Client arranges printing independently, the Client is responsible for confirming the printer's specifications.Where Wilkistration arranges printing on the clients behalf:• printing will not normally commence until the relevant Artwork has been approved and required payment received;
• print-production and delivery times are estimates;
• reasonable variation in colour, trimming and finishing may occur as part of normal commercial printing processes; and
• Wilkistration is not responsible for loss, damage or delay caused by an independent postal or courier provider outside Wilkistration's reasonable control._{23. Trademarks and Registration}Wilkistration does not provide legal trademark clearance or registration unless expressly stated otherwise.The Client is responsible for checking whether a proposed:• business name;
• product name;
• logo;
• slogan;
• domain name; or
• other brand elementis legally available and suitable for registration or commercial use.The creation of an original design does not guarantee that a similar trademark, registered or unregistered right does not already exist.

Website Design TermsThese terms apply in addition to the Core Terms where Wilkistration provides website design or website-building services._{24. Website Project Scope}The quotation or project brief will identify the website services included.This may include agreed:• page layouts;
• responsive design;
• visual design;
• website construction;
• content placement;
• navigation;
• forms;
• integrations; and
• other functionality.Pages, features or integrations not included in the agreed scope are additional work._{25. Website Platform}Websites may be constructed using an agreed website platform, builder or content-management system, including platforms such as Wix, Squarespace or Carrd, where appropriate.The Client is responsible for complying with the terms of any third-party platform used.Where ownership or control of an account, website or subscription is transferred to the Client, responsibility for maintaining the relevant subscription and account transfers to the Client.Client-Owned Accounts and CredentialsWhere reasonably possible, domains, hosting, website builders, analytics services and comparable accounts should be registered in the Client's name rather than Wilkistration's.The Client may provide Wilkistration with temporary administrator or collaborator access where required.The Client must not send passwords or sensitive credentials through insecure channels where a safer access method is reasonably available.Wilkistration may require the use of appropriate security measures, including two-factor authentication, where supported.Following handover, the Client is responsible for:• removing access that is no longer required;
• changing credentials where appropriate;
• maintaining account recovery information;
• maintaining two-factor authentication;
• keeping billing information current; and
• controlling subsequent third-party access.Wilkistration is not responsible for account security after its access has been removed or control has been handed back to the Client._{26. Domain Names, Hosting and Email}Unless expressly included in the project agreement, Wilkistration does not provide:• domain registration;
• domain renewal;
• website hosting;
• SSL certificate services;
• email hosting;
• email account configuration;
• spam management; or
• ongoing server administration.Where these services are supplied by a third party, the Client must contact the relevant provider regarding account, infrastructure and billing issues.The Client is responsible for maintaining active subscriptions and accurate account details after handover._{27. Client Website Content}The Client is responsible for providing website content unless copywriting or content creation is expressly included.The Client confirms that they have necessary rights and permissions for supplied:• text;
• photography;
• illustrations;
• video;
• audio;
• trademarks;
• logos;
• downloadable material; and
• other website content.The Client is responsible for the legality and factual accuracy of content published on their website.Wilkistration is not responsible for content subsequently added, amended or removed by the Client or another third party.Privacy, Cookies and Website Legal RequirementsUnless expressly agreed otherwise, Wilkistration does not provide legal advice or prepare legally approved:• privacy notices;
• cookie policies;
• terms and conditions;
• ecommerce terms;
• refund policies;
• statutory business disclosures;
• data-retention policies; or
• other legal documentation.Where the project includes implementation of a cookie banner, consent-management platform, privacy page or similar functionality, Wilkistration may implement the technical or visual components supplied or approved by the Client.The Client remains responsible for determining:• which laws apply to their website;
• what personal data the website collects;
• the lawful basis for processing;
• which cookies, pixels or tracking technologies may be used;
• what consent is required;
• what legal information must be displayed; and
• whether their policies accurately describe their activities.The Client should obtain appropriate legal or data-protection advice where required._{28. Website Review and Approval}When the initial website build is complete, Wilkistration will provide an opportunity for review.Unless otherwise stated in the quotation, the Client will have 14 days from delivery of the review version to request one set of minor corrections.Minor corrections may include:• small textual corrections;
• minor spacing adjustments;
• small layout corrections; and
• correction of implementation errors against the approved design.Minor corrections do not include:• substantial redesign;
• replacement of significant imagery;
• changes to the agreed colour scheme;
• new pages;
• new functionality;
• revised navigation structures;
• new integrations; or
• substantial changes to previously approved content.If no changes are requested during the review period, the website may be considered approved, subject to any statutory rights that cannot lawfully be restricted.Work requested after the review period may be quoted as a separate service.Defects and Change RequestsA defect is a fault in Wilkistration's implementation that causes an agreed feature or design to materially fail to operate or appear as agreed.A change request is a request to alter, extend or replace what was originally agreed.Correcting a defect attributable to Wilkistration during the review period will not count as a Client revision.Examples of change requests include:• changing the intended behaviour of a feature;
• adding functionality;
• redesigning an approved section;
• changing the navigation structure;
• adding pages; or
• replacing previously approved content or imagery.Change requests may be quoted separately.A problem caused by Client changes, third-party modifications, platform updates or services outside Wilkistration's control is not considered a Wilkistration defect.Nothing in this section removes statutory remedies available to consumer Clients for services not performed with reasonable care and skill._{29. Website Credit and Portfolio Use}Unless otherwise agreed in writing, the Client permits Wilkistration to include a small design credit in the website footer.The Client also permits Wilkistration to display the completed website and link to the live site for self-promotional purposes in accordance with Section 11._{30. Browser, Device and Responsive Compatibility}Wilkistration will use reasonable care to ensure that a website functions appropriately on the modern browsers and device sizes identified in the project scope.Websites cannot be guaranteed to appear identically on every:• device;
• screen size;
• operating system;
• browser;
• browser version; or
• user configuration.Support for obsolete or unsupported browsers is not included unless expressly agreed.Changes introduced by browser vendors, operating systems or third-party platforms after completion are outside Wilkistration's control._{31. Accessibility}Where accessibility requirements form part of the agreed scope, Wilkistration will design and implement the website with reference to the accessibility requirements identified for the project.Wilkistration may provide accessibility-focused design and implementation services but does not provide legal certification of compliance unless expressly agreed and professionally qualified to do so.Accessibility can be affected by:• Client-supplied content;
• third-party plugins;
• embedded media;
• subsequent Client changes;
• platform updates; and
• new content added after handover.The Client remains responsible for determining the legal accessibility obligations applicable to their organisation and maintaining the accessibility of subsequently added or modified content._{32. SEO and Search Engines}Where basic search-engine optimisation is included, Wilkistration will apply reasonable design and technical practices appropriate at the time of development.Wilkistration does not guarantee:• inclusion in any search engine;
• any particular search ranking;
• indexing of every page;
• a particular volume of traffic;
• enquiries, conversions or sales;
• continued performance of selected keywords; or
• how quickly search engines will index a website.Search-engine algorithms and ranking systems are operated by third parties and may change without notice._{33. Third-Party Integrations}Websites may make use of third-party:• plugins;
• widgets;
• APIs;
• payment providers;
• booking systems;
• analytics services;
• fonts;
• social-media integrations; or
• other external services.Wilkistration cannot guarantee continued availability, compatibility or functionality of a third-party service after completion.Changes, outages, discontinuation, pricing changes or altered terms imposed by those providers are outside Wilkistration's control.Additional work required because of a third-party change may be quoted separately._{34. Website Maintenance and Post-Completion Work}Unless a separate maintenance agreement has been made, ongoing website maintenance is not included after handover.Wilkistration is not responsible for routinely maintaining:• website content;
• CMS software;
• plugins;
• integrations;
• third-party applications; or
• other website components.following handover.Updates or amendments requested after the included review period are additional services and may be quoted separately._{35. Security, Availability and Backups}Wilkistration will build websites using reasonable practices available at the time of development.No website, server or online platform can be guaranteed to be continuously available or completely secure.Unless expressly included in an ongoing service agreement, Wilkistration is not responsible for losses caused by:• hosting outages;
• malicious attacks;
• hacking;
• malware;
• compromised Client credentials;
• data loss;
• third-party security vulnerabilities;
• service interruption; or
• obsolete third-party software arising after handover.where the matter is outside Wilkistration's reasonable control.Following handover, the Client is responsible for maintaining appropriate website backups unless a separate backup service has been agreed.Wilkistration is not responsible for faults or losses caused by alterations made after handover by the Client or another third party.

General Legal Terms

Liability}Wilkistration will provide its services with reasonable care and skill.Nothing in these Terms excludes or limits liability where doing so would be unlawful.Where the Client is a consumer, nothing in these Terms removes or reduces statutory rights or remedies available under consumer law.Subject to those protections, Wilkistration will not be responsible for loss caused solely by:• inaccurate Client instructions;
• Client-supplied material;
• unauthorised Client or third-party changes;
• third-party service failures outside • Wilkistration's reasonable control; or
• use of Deliverables for a purpose that was not disclosed or reasonably contemplated when the project was agreed.Business ClientsWhere the Client acts in the course of business, and to the extent permitted by law, Wilkistration will not be liable for indirect or consequential loss including loss of anticipated profit, revenue, savings, business opportunity or goodwill.Where liability can lawfully be limited, Wilkistration's aggregate contractual liability arising directly from a project will not exceed the amount paid by the Client to Wilkistration for the services directly giving rise to that claim.This limitation does not apply to liability that cannot lawfully be limited or excluded._{37. Changes to These Terms}Wilkistration may update these Terms from time to time.Updated Terms apply to projects entered into after the revised Terms are published or supplied to the Client.An existing project will remain governed by the version accepted when that project began unless both parties expressly agree otherwise in writing or a change is required by law._{41. Severability}If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.A failure to enforce a provision immediately does not waive the right to enforce it later._{42. Entire Agreement}These Terms, together with the relevant quotation, project brief, proposal, applicable appendices and any other expressly incorporated written agreement, form the agreement between Wilkistration and the Client for the relevant project.Changes to the agreed project terms should be confirmed in writing._{43. Governing Law and Jurisdiction}These Terms and any dispute or claim arising from or connected with them are governed by the laws of Scotland.Subject to any mandatory rights or jurisdiction available to a consumer, the courts of Scotland will have jurisdiction over disputes or claims arising from or connected with these Terms.

Commissions Wilkistration Will Not AcceptWilkistration does not accept commissions whose purpose is primarily connected with:• NFTs or other blockchain-based collectibles;
• cryptocurrency tokens or cryptocurrency projects;
• tokenisation of creative work;
• blockchain-based ownership of creative work;
• generative-AI products or services;
• generative-AI training datasets;
• generative-AI model development; or
• services primarily intended to generate, imitate or replace creative work using generative artificial intelligence.Wilkistration may decline or terminate a commission if its intended purpose was not disclosed when the project was agreed and subsequently becomes apparent to fall within these categories.Where work has already been completed before such information becomes known, the Client remains responsible for fees properly due for work completed up to termination.

Appendix A: Consumer Cancellation InformationThis Appendix applies only where the Client is legally acting as a consumer and statutory cancellation rights apply to the contract.It does not apply to a Client commissioning services wholly or mainly for their trade, business, craft or profession._{A1. Cancellation Period}For a qualifying distance or off-premises service contract, the consumer will normally have 14 days from the day after the contract is entered into in which to cancel without giving a reason, subject to applicable law.The Client may notify Wilkistration of cancellation using the form below or by making any other clear statement communicating their decision to cancel._{A2. Starting Work During the Cancellation Period}Wilkistration will not normally begin substantial work during a statutory cancellation period unless requested by the Client.If the Client wants work to begin before the cancellation period ends, Wilkistration may ask the Client to provide an express request for early performance.Where the Client validly cancels after expressly requesting that work begin during the cancellation period, the Client may be required to pay a proportionate amount for services supplied before cancellation, where permitted by law.If the service has been fully performed during the cancellation period, the Client may lose the statutory right to cancel where all legal requirements for that loss of cancellation rights have been satisfied, including any required express consent and acknowledgement._{A3. Appendix B: Data Processing AddendumThis Appendix applies only where Wilkistration processes personal data on behalf of the Client and the parties therefore act as Client/Controller and Wilkistration/Processor for that processing.It does not apply merely because Wilkistration holds ordinary Client contact or billing information for its own business purposes.B1. Details of the ProcessingThe applicable quotation, project brief or written processing instructions will identify:• Subject matter of processing [For example: website development, migration, maintenance or troubleshooting]

• Nature and purpose of processing
• Types of personal data [For example: names, contact details, account information, form submissions]

Sub-processors}Wilkistration will not appoint a sub-processor to carry out processing on behalf of the Client without the Client's prior specific or general written authorisation.Where general authorisation has been given, Wilkistration will provide reasonable notice of intended material changes to sub-processors so that the Client may raise legitimate data-protection objections.Wilkistration will ensure that an authorised sub-processor is subject to written data-protection obligations providing an appropriate level of protection for the relevant personal data.Wilkistration remains responsible for complying with its obligations relating to the sub-processor as required by applicable law._{B6. Data Subject Rights}Taking into account the nature of the processing, Wilkistration will provide reasonable assistance to the Client where necessary for the Client to respond to requests from individuals exercising applicable data-protection rights.If Wilkistration receives such a request directly relating to Client-controlled data, Wilkistration will normally refer the request to the Client rather than responding independently unless legally required to do otherwise._{B7. Security Incidents and Compliance Assistance}Wilkistration will notify the Client without undue delay after becoming aware of a personal-data breach affecting personal data processed on the Client's behalf.Taking into account the nature of the processing and information reasonably available to Wilkistration, Wilkistration will provide reasonable assistance with the Client's obligations relating to:• personal-data breaches;
• security of processing;
• data-protection impact assessments; and
• consultation with the relevant supervisory authority where required._{B8. Return and Deletion of Personal Data}At the end of processing, and at the Client's choice where applicable, Wilkistration will delete or return personal data processed on the Client's behalf and delete remaining copies unless applicable law requires retention.Where immediate deletion from a secure backup is not technically practicable, the data may remain beyond active use until it is deleted through the applicable backup or destruction cycle.This provision is separate from the general project-file retention clause. Personal data will not be retained solely because project files may otherwise be retained for up to six months._{B9. Audits and Information}Wilkistration will make available information reasonably necessary to demonstrate compliance with the processor obligations applicable to the processing covered by this Appendix.Wilkistration will allow for and reasonably contribute to audits or inspections required under applicable data-protection law.The parties will act reasonably regarding the timing, scope and confidentiality of any audit so that it does not unnecessarily disrupt Wilkistration's business or compromise another client's confidential information._{B10. • through a service or sub-processor authorised by the Client; and
• where any legally required safeguards for the transfer are in place._{B11. Controller Responsibilities}The Client remains responsible for its obligations as controller, including determining:• whether processing is lawful;
• what personal data Wilkistration is instructed to process;
• the lawful basis for processing;
• information provided to data subjects;
• applicable retention requirements; and
• whether any additional safeguards or impact assessments are required.The Client will not instruct Wilkistration to process personal data in a manner that the Client knows to be unlawful._{B12. End of Addendum}This Data Processing Addendum forms part of the agreement only for processing in which Wilkistration acts as a processor on behalf of the Client.If this Appendix conflicts with another part of the Terms regarding processing of Client-controlled personal data, this Appendix will take priority to the extent of that conflict.
